Terms and Conditions

1. Validity

These conditions apply to every agreement to guide activities and travel between Dutch Husky Experience and the participant in an experience, to which these conditions have been declared applicable.

2. Agreement An agreement is concluded by sending the completed registration form by the participant to Dutch Husky Experience. This is done via the online form on www.dutchhusky.nl

3. Personal dataBy registering, the participant agrees that his/her data will be provided to STO Garant.

4. Program change Dutch Husky Experience makes every effort to ensure that the intended experience proceeds according to the information provided in advance. The Dutch Husky Experience instructor/guide, Danny Bekker or his replacement, has the right to make necessary program changes in his/her opinion, to ensure the safety of the participants and themselves. Consideration should be given to circumstances such as weather, avalanche danger, terrain and the health of the participants or the instructor himself.

5. Accommodation You will spend the night in shelters, cabins, tents or (mountain) huts.

6. Insurance Every participant is obliged to take out travel accident insurance that covers high-risk sports. This is possible, for example, at the Dutch Climbing and Mountain Sports Association. If the participant is already a member of the NKBV (annual subscription is €51 in 2016), the insurance can be taken out for €28 (price level in 2016). If the participant has a continuous travel insurance, he/she will therefore check whether high-risk sports are co-insured.

7. Cancellation

Cancellation by the participant must be made by telephone or text message to the following telephone number of Dutch Husky Experience: +316 400 513 43. In case of cancellation of the Experience less than 7 days before the start date of the tour, 100% of the total amount remains due. In case of cancellation less than 14 days before the start date, the participant owes 75% of the total amount, less than 28 days before the start date 50%, and in case of cancellation longer than 28 days, only the down payment is due. Dutch Husky Experience has the right to cancel an Experience in any case if the number of registrations is less than the number published in the programme. In that case, Dutch Husky Experience will return the amounts paid to the participants after deduction of the costs already incurred for the trek and/or expedition, such as rent or down payment for accommodation, which can no longer be refunded. In this situation, Dutch Husky Experience cannot be held liable for any damage suffered by a participant. Cancellation by Dutch Husky Experience in a case other than the number of registrations will be avoided to the utmost. At all times an attempt will be made to find a replacement, equivalent instructor/guide. If that does not work, it will be canceled and all money already paid by the participants will be refunded less the costs already incurred for the Experience such as rent or down payment of accommodation, which can no longer be refunded.

8. Physical condition Each participant must meet the physical condition as stated in the program. She/he is also obliged to indicate on the registration form if medication is being taken and/or conditions are present that may affect the functioning of that participant.

9. Exclusion of liability Dutch Husky Experience ensures a safe and responsible Experience. To this end, Dutch Husky Experience works with experienced guides and/or instructors. Extensive risk analyzes and emergency protocols are also drawn up prior to departure.

Dutch Husky Experience excludes any liability for personal injury and for damage to any property of the participant. The participant must be aware that a Dutch Husky Experience entails risks and must sign a risk acceptance form before the start. The risk acceptance form can be viewed and the participant indicates his willingness to sign it when registering.

The guide of Dutch Husky Experience can deny participants participation in the entire activity, or certain parts thereof, on the basis of their own assessment. Participants of Dutch Husky Experience trips must have a good basic condition.

10. Guarantee scheme STO Garant

To comply with the legally required guarantee, Dutch Husky Experience uses STO Garant, a guarantee scheme recognized by the Authority for Consumers and Markets (ACM). You can check this via the STO Garant participants page (www.sto-garant.nl/deelnemers). All information about STO Garant can be found at www.sto-garant.nl.

With every (travel) offer of Dutch Husky Experience on this website you can read whether the guarantee of STO Garant applies. In the guarantee scheme you can read what the guarantee entails and which conditions apply. You can find this guarantee scheme on the website of STO Garant (www.sto-garant.nl/downloads).

11. The payment procedure

If the guarantee of STO Garant applies to your booking, you do not pay the travel sum to Dutch Husky Experience, but to the escrow account of Stichting Derdengelden Certo Escrow, with De Nederlandsche Bank (DNB) and the Netherlands Authority for the Financial Markets (AFM) registered payment service provider. This third-party funds foundation guarantees your travel sum until after your booking has ended. The day after the trip, the travel sum is released to Dutch Husky Experience. Should Dutch Husky Experience become financially insolvent before the end of your booking, STO Garant will carry out the guarantee. In the guarantee scheme you can read how you can claim this in that case.
